Terms of Service

Effective Date: June 3, 2026

These Terms of Service (“Terms”) govern your access to and use of the Curb Appeal Photography website, booking tools, scheduling pages, payment links, media delivery systems, property websites, 3D tour links, digital products, and all photography, videography, drone, floor plan, virtual staging, and related real estate marketing media services provided by Curb Appeal Photography (“Curb Appeal Photography,” “CAP,” “we,” “us,” or “our”).

By accessing our website, booking a service, submitting payment, downloading media, using delivered files, or otherwise using our services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our website or services.

1. Company Information

Curb Appeal Photography provides professional real estate photography, videography, drone aerial media, 3D virtual tours, floor plans, virtual staging, property websites, and related marketing media services for real estate agents, brokers, builders, developers, apartment communities, commercial property owners, hospitality businesses, short-term rental hosts, interior designers, and other clients.

We reserve the right to update these Terms at any time. When updates are made, the effective date will be revised. Continued use of our website, services, or delivered media after updates are posted means you accept the revised Terms.

2. Description of Services

Curb Appeal Photography offers professional visual media services, which may include:

  • Residential real estate photography
  • Commercial real estate photography
  • Real estate videography
  • Social media reels and vertical video content
  • Drone aerial photography and video
  • 3D virtual tours
  • Floor plans
  • Virtual staging
  • Property websites
  • Apartment community media
  • Builder and developer media
  • Hospitality, restaurant, and business media
  • Realtor branding, lifestyle, and headshot photography
  • Related editing, delivery, marketing, and media services

Specific deliverables, pricing, turnaround times, and service details may vary based on the package selected, property size, location, scope of work, weather conditions, access, scheduling availability, and project requirements.

We reserve the right to modify, suspend, discontinue, or change any service, package, price, or deliverable at any time.

3. Eligibility and Client Responsibilities

You must be at least 18 years old and legally able to enter into a binding agreement to use our services.

By booking a service, you represent that:

  • You are authorized to request media services for the property, business, listing, rental, community, or project being photographed or filmed.
  • You have permission for our team to access the property at the scheduled time.
  • You have secured any required approvals from property owners, tenants, occupants, HOAs, building management, security personnel, listing agents, brokers, or other necessary parties.
  • The information you provide to us is accurate, complete, and current.
  • You will comply with these Terms, our licensing terms, payment terms, and all applicable laws.

You are responsible for providing accurate property addresses, gate codes, lockbox codes, access instructions, parking details, contact information, and any other information needed for us to complete the appointment.

4. Booking and Scheduling

Appointments are subject to availability and are not guaranteed until confirmed by Curb Appeal Photography.

When booking a service, you agree to provide accurate information, including the property address, requested services, preferred appointment time, property size, access instructions, and any special notes.

We make reasonable efforts to arrive during the scheduled appointment window. However, delays may occur due to traffic, weather, prior appointments, access issues, safety concerns, or other circumstances outside our control.

If our team cannot access the property, cannot complete the service due to unsafe conditions, or is delayed because required information was not provided, additional fees may apply.

5. Property Readiness

All staging, cleaning, decluttering, repairs, landscaping, construction, and preparation must be fully completed before the scheduled appointment time.

The property must be photo-ready when our photographer, videographer, drone operator, or service provider arrives. This includes, but is not limited to:

  • Cleaning and decluttering interior spaces
  • Removing personal items, trash, laundry, dishes, and unnecessary items
  • Making beds and arranging furniture
  • Turning on lights and replacing burned-out bulbs
  • Opening blinds or curtains as appropriate
  • Securing pets
  • Preparing exterior areas, including lawn care, driveway, patios, pools, decks, and porches
  • Removing vehicles from driveways or key exterior areas when possible
  • Completing all construction, staging, painting, repairs, and cleaning before arrival

Our team is not responsible for cleaning, staging, moving furniture, making beds, hiding personal items, removing trash, landscaping, or preparing the property unless specifically agreed in writing.

If the property is not ready at the scheduled time, we may proceed as-is, reschedule the appointment, or charge additional fees.

6. Access, Safety, and On-Site Conditions

You agree to provide safe, legal, and reasonable access to the property.

Our team may decline, pause, or terminate a service if they encounter unsafe, unsanitary, illegal, threatening, or unreasonable conditions, including but not limited to:

  • Aggressive animals
  • Unsafe structures, construction zones, exposed wiring, mold, hazardous materials, or biohazards
  • Illegal activity
  • Threatening or abusive behavior
  • Severe weather or unsafe drone flight conditions
  • Restricted access areas
  • Occupants, tenants, or third parties who refuse access

If a service cannot be completed due to access issues, property readiness issues, unsafe conditions, or client-provided misinformation, the appointment may be considered billable and additional fees may apply.

7. Payment Terms

Payment is due according to the terms shown at booking, on the invoice, or in the applicable service agreement.

Unless otherwise agreed in writing:

  • Payment may be required at booking to secure the appointment.
  • Payment must be received before final media files are released, downloaded, published, or used for marketing.
  • Unpaid orders may be withheld, delayed, watermarked, disabled, or removed from delivery access until payment is completed.
  • You authorize Curb Appeal Photography or its payment processor to charge your selected payment method for the services ordered, including applicable taxes, fees, add-ons, rescheduling fees, cancellation fees, travel fees, rush fees, hosting fees, revision fees, or other approved charges.
  • Returned payments, chargebacks, or failed payments may result in additional fees and suspension of access to delivered media.

All prices are in U.S. dollars and are subject to change at any time. Quotes, estimates, and package pricing are valid only for the stated time period or, if no period is stated, until changed by Curb Appeal Photography.

8. Cancellation and Rescheduling Policy

Unless otherwise agreed in writing:

  • There is no fee if you cancel or reschedule at least 24 hours before the scheduled appointment start time.
  • A cancellation or rescheduling fee may apply if you cancel or reschedule within 24 hours of the scheduled appointment start time, including same-day cancellations.
  • Same-day access issues, denied access, lockbox problems, gate code issues, unprepared properties, unsafe conditions, or client no-shows may be treated as late cancellations.
  • Weather-related rescheduling may be handled at our discretion, especially for exterior photography, drone services, video, twilight photography, and other weather-dependent services.

Curb Appeal Photography reserves the right to cancel or reschedule appointments due to weather, safety, illness, equipment issues, access concerns, traffic, emergency circumstances, or other factors outside our control.

9. Turnaround Times and Delivery

Estimated turnaround times are provided as a general guideline and may vary depending on the service type, property size, order volume, editing requirements, weather, revisions, add-ons, weekends, holidays, or other circumstances.

Delivery may be provided through online galleries, download links, cloud storage, property websites, 3D tour links, client portals, email links, or other digital delivery systems.

Curb Appeal Photography is not responsible for delays caused by incorrect email addresses, client technology issues, third-party platform outages, unpaid invoices, revision requests, incomplete information, or circumstances beyond our control.

You are responsible for downloading, saving, backing up, and properly storing delivered files. We may retain copies, but we do not guarantee indefinite storage or availability of files unless a specific hosting or storage agreement applies.

10. Revisions and Editing

Curb Appeal Photography provides professional editing according to our standard editing style and workflow.

Standard editing may include reasonable adjustments such as exposure, color balance, contrast, vertical alignment, sky or window balancing where applicable, and general image optimization.

Unless specifically included in your package or approved as an add-on, standard editing does not include:

  • Major object removal
  • Extensive retouching
  • Removing vehicles, power lines, stains, damage, clutter, or personal belongings
  • Virtual staging
  • Digital twilight conversion
  • Grass replacement
  • Major Photoshop manipulation
  • Image compositing
  • Floor plan redraws beyond the original scope
  • Video re-edits based on preference changes after approval or delivery

Revision requests must be submitted within a reasonable time after delivery. Additional fees may apply for revisions outside the original scope, style preference changes, rush edits, re-edits, or requests caused by property readiness issues.

11. Drone Services

Drone photography and video services are subject to weather, airspace restrictions, FAA rules, property conditions, safety concerns, equipment limitations, and pilot discretion.

Curb Appeal Photography reserves the right to decline, modify, delay, reschedule, or cancel drone operations if conditions are unsafe, restricted, illegal, impractical, or not suitable for flight.

Drone services are not guaranteed for every property or appointment. Factors that may prevent drone operations include, but are not limited to:

  • Rain, high winds, poor visibility, or unsafe weather
  • Restricted airspace
  • Proximity to airports, heliports, stadiums, government facilities, prisons, emergency operations, or other sensitive areas
  • Trees, power lines, buildings, towers, or other flight hazards
  • Crowds, traffic, or unsafe takeoff and landing areas
  • FAA restrictions or temporary flight restrictions
  • Pilot safety judgment

If drone services cannot be completed, we may offer an alternative, partial adjustment, reschedule, or replacement service at our discretion.

12. 3D Tours, Floor Plans, Virtual Staging, and Property Websites

Certain services may rely on third-party software, hosting platforms, measurement systems, or rendering tools.

3D Tours

3D tour availability, hosting, links, measurements, dollhouse views, floor views, and other features may depend on third-party platforms. Hosting may be included for a limited time, after which additional hosting fees may apply.

Floor Plans

Floor plans are intended for marketing and general visual reference only. They are not architectural drawings, appraisals, surveys, engineering documents, or guaranteed measurements. Measurements may be approximate and should not be relied upon for construction, legal, appraisal, permitting, or valuation purposes.

Virtual Staging

Virtual staging is a digital marketing enhancement. Virtually staged images may not represent the current physical condition of the property. Clients are responsible for disclosing virtual staging where required by MLS rules, advertising rules, brokerage rules, platform rules, or applicable law.

Property Websites

Property websites may include photos, videos, 3D tours, floor plans, listing details, agent branding, brokerage information, and related marketing assets provided by the client or created by Curb Appeal Photography. Property website hosting may be limited in duration and may be subject to additional hosting or renewal fees.

13. Media Licensing and Usage Rights

Unless otherwise agreed in writing, all photos, videos, drone media, 3D tour content, floor plans, virtual staging files, property websites, and other deliverables are licensed, not sold.

Curb Appeal Photography retains all copyrights and ownership rights in the media we create, except where otherwise agreed in a separate written agreement signed by Curb Appeal Photography.

Upon full payment, the client receives a limited, non-exclusive, non-transferable license to use the delivered media for the marketing of the specific property, listing, rental, business, community, or project for which the media was originally created.

This license may include standard real estate marketing uses such as:

  • MLS listing use
  • Brokerage websites
  • Real estate portals
  • Property websites
  • Social media posts
  • Email marketing
  • Digital ads for the specific listing or project
  • Flyers, brochures, postcards, and standard print marketing for the specific listing or project
  • On-property signage for the specific listing or project

Unless approved in writing, the media may not be:

Sold, transferred, gifted, sublicensed, or assigned to another agent, broker, seller, buyer, builder, vendor, publication, or third party
Reused to market another property, listing, rental, business, community, or project
Used for general brand advertising, company advertising, recruiting, stock imagery, commercial campaigns, magazine/newspaper publication, editorial use, or third-party advertising
Edited, filtered, altered, or modified in a way that misrepresents the property or damages the reputation of Curb Appeal Photography
Submitted to contests, publications, vendors, builders, designers, architects, contractors, or other third parties without written permission
Used after the original listing or project has expired, been withdrawn, sold, leased, transferred, re-listed, or assigned to another agent unless a new license is granted

If the property is re-listed, transferred to a new agent, assigned a new MLS number, marketed under a new listing agreement, reused by a builder, reused by a broker, or used for a different campaign, a new license may be required.

Payment in full is required before any license is granted.

14. Client-Provided Materials

If you provide logos, listing descriptions, property details, branding materials, music, copy, photos, video clips, graphics, or other materials, you represent that you have the legal right to provide and use those materials.

You grant Curb Appeal Photography permission to use client-provided materials as needed to complete the requested services, including editing, designing, publishing, delivering, or hosting project-related materials.

You are responsible for the accuracy, legality, and rights clearance of any materials you provide.

15. Portfolio and Marketing Use by Curb Appeal Photography

Unless otherwise agreed in writing, Curb Appeal Photography may use completed media for our own portfolio, website, social media, advertising, sample galleries, sales presentations, educational content, internal training, awards, and promotional materials.

If a property, client, homeowner, builder, designer, or business requires confidentiality or restricted use, that restriction must be requested in writing before the appointment or project begins and must be approved by Curb Appeal Photography.

We will use reasonable judgment when sharing media and will avoid intentionally disclosing private or sensitive personal information.

16. MLS, Brokerage, Platform, and Legal Compliance

Clients are responsible for ensuring that their use of delivered media complies with all applicable MLS rules, brokerage rules, advertising laws, fair housing laws, platform terms, copyright laws, drone-related restrictions, and any other legal or professional requirements.

Curb Appeal Photography is not responsible for MLS violations, platform removals, advertising claims, disclosure failures, inaccurate listing information, virtual staging disclosure issues, or misuse of delivered media by the client or third parties.

17. Prohibited Conduct

You agree not to:

  • Use our website or services for any unlawful, fraudulent, abusive, or misleading purpose
  • Submit false, inaccurate, or unauthorized booking information
  • Use delivered media without payment in full
  • Transfer, resell, sublicense, copy, or reuse media outside the license granted
  • Remove watermarks, copyright notices, branding, metadata, or usage restrictions without permission
  • Harass, threaten, abuse, or endanger any member of our team
  • Request that our team perform unsafe, illegal, or unauthorized activity
  • Attempt to interfere with our website, booking tools, payment systems, delivery links, property websites, servers, or networks
  • Use bots, scrapers, automated tools, or other methods to extract data or media from our website or systems
  • Reverse engineer, copy, or exploit any portion of our website, systems, processes, or digital products

Violation of these Terms may result in cancellation of services, suspension of delivery access, revocation of license rights, refusal of future service, legal action, and/or additional fees.

18. Intellectual Property

All content on the Curb Appeal Photography website, including text, graphics, logos, service descriptions, images, videos, layouts, designs, pricing structure, branding, and other materials, is owned by or licensed to Curb Appeal Photography and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, display, publish, scrape, or exploit any website content or company materials without our prior written permission.

All media created by Curb Appeal Photography remains protected by copyright and is subject to the license terms described in these Terms or any separate written agreement.

19. Third-Party Services

Our services may involve third-party platforms, including scheduling systems, payment processors, cloud storage providers, media delivery platforms, 3D tour platforms, floor plan providers, property website tools, email marketing platforms, analytics tools, advertising platforms, and social media services.

We are not responsible for the availability, security, performance, errors, outages, policies, pricing changes, or data practices of third-party platforms.

Your use of third-party services may be subject to their own terms and privacy policies.

20. Disclaimer of Warranties

OUR WEBSITE, SERVICES, MEDIA, DELIVERY SYSTEMS, PROPERTY WEBSITES, 3D TOURS, FLOOR PLANS, VIRTUAL STAGING, AND RELATED DELIVERABLES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURB APPEAL PHOTOGRAPHY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND ERROR-FREE OPERATION.

We do not guarantee that:

  • Our website or services will be uninterrupted or error-free
  • Media delivery links or third-party platforms will always remain available
  • A property will sell, lease, book, rent, or receive increased traffic because of our services
  • Drone services will be available for every property
  • Weather, lighting, staging, property condition, or access conditions will produce a specific result
  • Third-party platforms will accept, display, or host media in a specific way

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURB APPEAL PHOTOGRAPHY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, REPRESENTATIVES, VENDORS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST SALES, LOST LISTINGS, LOST BUSINESS, LOSS OF DATA, LOSS OF GOODWILL, PLATFORM OUTAGES, MLS ISSUES, THIRD-PARTY CLAIMS, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF OUR WEBSITE, SERVICES, OR DELIVERED MEDIA.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO CURB APPEAL PHOTOGRAPHY FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

22. Indemnification

You agree to indemnify, defend, and hold harmless Curb Appeal Photography and its owners, officers, employees, contractors, agents, representatives, vendors, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your use of our website, services, or delivered media
  • Your violation of these Terms
  • Your failure to obtain property access, permissions, approvals, or releases
  • Your misuse, transfer, resale, or unauthorized use of media
  • Your violation of copyright, trademark, privacy, publicity, MLS, brokerage, advertising, fair housing, or other laws or rules
  • Inaccurate, unlawful, or unauthorized materials or information you provide
  • Claims made by property owners, tenants, occupants, agents, brokers, builders, designers, contractors, vendors, publications, platforms, or other third parties related to your use of the media or services

23. Dispute Resolution

Before filing any formal legal claim, you agree to contact Curb Appeal Photography and attempt to resolve the dispute informally.

We will make a good-faith effort to resolve the matter within a reasonable period of time.

If the dispute cannot be resolved informally, any legal action or proceeding not otherwise resolved by agreement shall be handled according to the governing law and jurisdiction provisions below.

24. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles.

Unless otherwise required by applicable law, you agree that any dispute arising out of or related to these Terms, our website, our services, or delivered media shall be brought in the state or federal courts located in Georgia.

25. Termination or Refusal of Service

Curb Appeal Photography reserves the right to refuse, suspend, cancel, or terminate service at any time, including for:

  • Non-payment
  • Unsafe conditions
  • Abusive or unprofessional conduct
  • Violation of these Terms
  • Unauthorized use of media
  • Repeated cancellations or access issues
  • Requests that are illegal, unsafe, misleading, or outside our service standards

Upon termination, any unpaid invoices remain due, and any license to use unpaid media is revoked.

26. General Provisions

These Terms, together with any invoice, estimate, booking confirmation, service agreement, license agreement, or written policy provided by Curb Appeal Photography, constitute the agreement between you and Curb Appeal Photography regarding the services provided.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations in connection with a business transfer, merger, acquisition, restructuring, or sale of assets.
